Acceptable Usage Policy

1. Introduction

This Acceptable Use Policy (“AUP” or “Policy”) outlines the rules and guidelines governing the use of services (“Services”) provided by IllyVoIP LLC (“IllyVoIP,” “we,” “us,” or “our”) to its customers, users, and end-users (“Users”). This Policy applies to all use of our products, services, software, and network infrastructure. By using our Services, you agree to comply with this AUP. In the event of a conflict between this Policy and any specific customer agreement, the customer agreement shall prevail.

We may update this Policy from time to time. Users will be notified of significant changes via email, account notifications, or by posting an updated version on our website. Your continued use of the Services after modifications become effective constitutes acceptance of the updated Policy. Please review this Policy periodically.


2. Prohibited Activities

You agree not to use our Services for any purpose that, in our sole discretion, is illegal, inappropriate, or improper (“Prohibited Activities”). The examples below are not exhaustive but provide guidance on unacceptable uses:

2.1. Illegal Purposes

  • Law Violations: Using our Services to violate any applicable law, rule, regulation, governmental order, or industry standard.
  • Harmful Behavior: Engaging in threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, or otherwise illegal conduct.

2.2. Inappropriate and Improper Uses

  • Harmful Content: Transmitting, storing, posting, or calling with content that is unsolicited, offensive, harassing, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • Misrepresentation: Falsifying or providing misleading information, including but not limited to User identity, intent, or use of Services.
  • Spam and Unsolicited Communications: Initiating repetitive, continuous, or automated calls/messages that are unsolicited or in violation of consent requirements, including failure to honor opt-out requests.
  • Abnormal Traffic or Usage Patterns:
    • Engaging in activity that significantly exceeds expected or normal usage, inconsistent with business purposes, or which provokes complaints.
    • Utilizing services in a way that artificially inflates traffic, such as excessive simultaneous calls or messages.
  • Long-Duration Calls and Fraudulent Activity:
    • Conducting excessively long calls (e.g., more than four cumulative hours to the same number in 24 hours) without legitimate business reason.
    • Placing calls or sending messages solely to generate charges, fees, or fraudulent billing.
  • Network Abuse: Any activity that harms or interferes with:
    • IllyVoIP’s network infrastructure.
    • The integrity, security, or performance of the Services.
    • Other Users’ ability to use the Services.
    • Attempts to bypass, exploit, or undermine service limitations or security features.
  • Unauthorized Access and Security Breaches:
    • Accessing our network, systems, or data without authorization.
    • Probing, scanning, testing, or bypassing security mechanisms of our network or services.
    • Distributing malware, viruses, worms, or other harmful code.
  • Intellectual Property and Fraud:
    • Violating or infringing on intellectual property rights.
    • Using Services to engage in fraud, spoofing caller identification, or other deceptive practices.
  • Spam and Telemarketing Violations:
    • Sending unsolicited advertising, marketing messages, or robocalls that violate applicable laws, including spam regulations and telemarketing rules.
    • Use of IllyVoIP-provided phone numbers to spoof caller ID for fraudulent or deceptive purposes.
  • Resource Abuse:
    • Operating servers in configurations that allow open relaying or mass mailing (e.g., open mail relays).
    • Exceeding usage thresholds (e.g., calls per second limits) in a manner inconsistent with normal business practices.
    • Engaging in auto-dialing, predictive dialing, or similar activities that can cause harm or trigger complaints.
  • Service Interference:
    • Restricting or inhibiting other Users’ use of the Services or network.
    • Using the Services to facilitate harmful activities through third-party providers or channels.
  • Industry-Specific Violations:
    • Conducting activities related to prohibited industries (e.g., pornography, illicit drug sales) that violate laws or industry standards.
    • Engaging in activities that breach telecommunications regulations, such as violating Number Portability Administration Center (NPAC) policies.


3. Enforcement and Remedies

IllyVoIP reserves the right to take any necessary actions to enforce this AUP or to protect the integrity of its network and services, including but not limited to:

  • Suspension or Termination: Immediate suspension or termination of user accounts and Services, with or without notice, and application of cancellation or termination fees as applicable.
  • Legal Action: Cooperation with law enforcement agencies, pursuing legal remedies against violators, and providing evidence of misuse to third parties.
  • Data Disclosure: Sharing information with third parties, as required, including notification to affected parties if their rights have been violated.
  • Network Protections: Implementing technical measures to prevent further violations and mitigate harm caused by any breach of this Policy.

IllyVoIP's failure to take action in response to a violation does not constitute a waiver of its rights under this Policy.


4. Additional Terms and Compliance

  • Customer-Specific Requirements: Certain Services may be subject to additional usage requirements or restrictions, which will be communicated separately or available via customer portals or legal pages.
  • Compliance with Agreements: Users must also adhere to any additional terms outlined in their specific service agreements, terms of service, or contracts with IllyVoIP.
  • Notification of Abuse: Users are encouraged to report any suspected violations of this Policy to IllyVoIP’s support or compliance team.


5. Amendments to the AUP

IllyVoIP may amend this AUP at its sole discretion. Changes will be posted on our website, and your continued use of our Services after such changes are effective constitutes acceptance of the updated Policy. Users are responsible for reviewing this AUP periodically to remain informed of any changes.
